This privacy policy applies to the Croux platform and all sites, services, and applications by Croux, Inc. By using or accessing the Platform, you accept the practices outlined below and consent to our collection, use, and sharing of your information as described here.
Croux reserves the right to change this policy at any time. By continuing to use the Platform, you accept any changes at the time they are implemented.
Scope
This privacy policy describes how any personal information collected as a result of your use of the Platform will be maintained by Croux.
Collection of Personal Data & Company Data
When you access the Platform, Croux will collect some personal data from you. In some instances, Croux may gain access to personal data through third-parties or affiliates. Information that may be collected includes, but is not limited to:
- Contact information such as name, email address, address and telephone number
- Login timestamps, source IP address and the user agent (browser and version)
- Financial information such as credit card or bank account numbers
- Additional information required to verify your identity
- Logs, contact information and other information about communications between registered users
- Information based on your activities using the Platform, such as search information, page views, traffic data, Platform engagement, ad data, and IP address
- Supplemental information from third parties (for example, credit checks as permitted by law)
- Voice and audio data, including recordings of TARA interactions and the transcripts generated from them
- AI-generated or AI-assisted profile content, including inferences about your skills, certifications, availability, and experience derived from your interactions with TARA or other automated tools
- Information you provide during automated screening or intake conversations
- Any other information you may provide
In addition to Personal Data, Croux may collect Company Data including Consumer Data, Analytics Data, Inventory and Supply Chain Data, Product Data, Marketing Data, and Employee Data.
If you sign in through a third-party company, you authorize us to collect, store, and use any information that third-party provides us through their API.
If you make a purchase or subscribe to a service, you may be required to provide payment information including bank account numbers, credit card or debit card numbers, and ACH information. Such Payment Information will be collected and processed by Croux or its third-party payment vendors.
Data Security and Retention
Croux seeks to protect Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures. You should also help protect your data by selecting a strong password, limiting access to your device and browser, and signing off after accessing your account. No method of transmitting data over the internet or storing data is completely secure.
We retain Personal Data for as long as you have an open account with us or as otherwise necessary to provide access to the Platform. Log data is held for one year. Croux may retain Personal Data longer if necessary to comply with legal obligations, resolve disputes, or collect fees owed, as permitted by applicable law.
Audio recordings from TARA interactions are retained for up to 12 months after the interaction and are then deleted or de-identified, unless a longer period is required by law or reasonably necessary to investigate fraud, enforce the Terms of Service, resolve a dispute, or comply with a legal hold. Transcripts, profile content, and related business records may be retained for longer periods consistent with this policy and applicable law.
Third-Party Analytics
Croux and its technology partners may use third-party analytics services (e.g., Google Analytics) to evaluate your use of the Platform, compile reports, collect demographic data, and analyze performance metrics. These third parties use cookies and other technologies to help analyze and provide data to Croux. You consent to the processing of data about you by these analytics providers as set out in this Privacy Policy.
For more information on these third parties, including how to opt out from certain data collection, please contact us at support@croux.co. If you opt out of any such service, you may not be able to use the full functionality of the Platform.
Use
All personal data collected will be used primarily to provide the Services in an effective and personalized manner. Your personal information may be used to:
- Provide customer support and services, including confirming emails, reminders, and transactions
- Facilitate communication between interested parties registered on the Platform
- Customize your experience and measure and improve the Platform
- Keep you informed about targeted marketing, service updates, and promotional offers
- Compare information for accuracy and verify it with third parties
- Measure consumer interest in Croux's products and services
- Detect and prevent error, fraud, and other potentially prohibited or illegal activity
- Enforce the Terms of Service and other agreements and policies of the Platform
- Collect fees as described at the time of collection
- Operate, evaluate, and improve automated systems and AI features, including TARA
- Generate, review, and update Talent profiles, eligibility indicators, and the Trust Score, including from inferences drawn from automated interactions
- Conduct screening, intake, content moderation, and fraud and safety assessments using automated tools
- Train, test, and improve our automated systems, subject to applicable law and any consent required
Automated Tools and Artificial Intelligence
Croux uses automated systems and artificial intelligence to operate and improve the Platform. These tools may be used to analyze usage patterns, generate recommendations, provide eligibility indicators (including the Trust Score), assess fraud or safety risks, support content moderation, and create or enhance Talent profiles.
Human review. For any significant decision that is materially influenced by an automated tool — including account deactivation, denial of platform access, or material adjustments to your eligibility or Trust Score — you may request a human review by contacting support@croux.co.
Correction of AI-generated profile content. If information generated or inferred by an automated tool (including TARA) about you is inaccurate, you may request correction by contacting support@croux.co. We aim to respond within 2 business days.
TARA — AI Voice Agent
Croux may use an AI voice agent called TARA to conduct intake and screening conversations and to create or enhance Talent profiles.
Disclosure at the start of a call. TARA will identify itself as an automated system at the beginning of any interaction. Where applicable law requires consent before recording, we will request that consent at that time. If you do not consent, you should not proceed with the recorded interaction; you may instead request a human-conducted or other reasonable alternative intake by contacting support@croux.co. We aim to respond within 2 business days.
What we collect from TARA interactions. Audio recordings, transcripts, metadata about the interaction (such as time, duration, and device or network identifiers), and information you provide during the conversation. We may also generate inferences from your responses, such as skills, certifications, availability, and experience.
How we use this information. To operate the Services; to create, update, and improve your Talent profile; to generate or support eligibility indicators, including the Trust Score; to maintain safety, quality, fraud-prevention, and compliance records; and to develop, test, maintain, and improve TARA and related features.
Who we share it with. Information from TARA interactions is made available to Croux personnel and to service providers and vendors that operate, host, transcribe, or analyze the Service on our behalf under contract. We do not sell TARA recordings or transcripts, and we do not share them with third parties for their own marketing purposes. We may disclose them as required by law or legal process, or to protect the rights, property, or safety of users or the public.
Retention. Unless a longer period is required by law or reasonably necessary to investigate fraud, enforce the Terms of Service, resolve a dispute, or comply with a legal hold, Croux retains raw audio recordings from TARA interactions for up to 12 months after the interaction and then deletes or de-identifies them. Transcripts, profile content, and related business records may be retained for longer periods as described in the "Data Security and Retention" section of this policy.
Alternatives and accommodations. If you prefer not to use TARA, or if you require an accommodation, you may request a human-conducted or other reasonable alternative intake at support@croux.co. We aim to respond within 2 business days.
Your choices regarding profile content. You may review your profile and request correction of inaccurate TARA-generated content by contacting support@croux.co. We aim to respond within 2 business days.
Voice and Biometric Information
Unless Croux expressly states otherwise in a separate notice, ordinary audio recordings and transcripts collected in connection with TARA or similar features are not used by Croux as biometric identifiers to uniquely identify you.
If Croux introduces a feature that collects or processes voiceprints or other biometric identifiers, we will provide a separate notice and obtain any consent required by applicable law before collection, and we will retain and delete such data as required by law.
Disclosure
Croux may share analytics and non-identifying information without your explicit consent. Croux may share some or all of your personal information with:
- Subsidiaries and assigns of Croux and affiliates
- Law enforcement offices, third-party rights owners, or others where disclosure is reasonably necessary to enforce our policies, respond to claims, or protect the rights, property or safety of users or the public
- Parties to whom you grant permission for Croux to share
- Service providers under contract who help with our business operations
- As permitted by law or in response to subpoenas, court orders or other legal process
Mobile Information Sharing. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All categories listed above exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Audio recordings, transcripts, and AI-generated profile content from TARA interactions are shared only with Croux personnel and with service providers and vendors that operate the Service on Croux's behalf under contract; with parties to whom you have granted permission; and as required by law or legal process. Croux does not sell this information and does not share it with third parties for their own marketing purposes.
Communication
Croux may collect information related to marketing and branding. You agree for someone from or on behalf of Croux to contact you by any means provided for contact through your use of the Platform.
Email Preferences
All users have the opportunity to opt out of receiving nonessential (promotional or marketing-related) communications from Croux after setting up an account. To remove your contact information from Croux's lists and newsletters, unsubscribe by following the opt-out link included in each email.
Cookies
The Platform may use cookies and similar technologies such as pixel tags, web beacons, clear GIFs and JavaScript to recognize your web browser, tell us how and when you visit and use the Platform, analyze trends, and operate and improve the Platform.
We may utilize the following types of Cookies:
- Essential Cookies: Required for providing features or services you have requested. Disabling these may make certain features unavailable.
- Functional Cookies: Used to record your choices and settings, maintain your preferences over time, and recognize you when you return.
- Performance/Analytical Cookies: Allow us to understand how users use the Platform by collecting information about visitors, page views, and time on page.
- Retargeting/Advertising Cookies: Collect data about your online activity and identify your interests so that we can provide relevant advertising.
If you do not want Croux to deploy cookies, you can opt out by setting your device to reject cookies. You can still use the Platform if you disable cookies, although some features may be affected.
Accessing, Reviewing and Changing Your Personal Information
You are responsible for the personal information you provide upon registering and for making any necessary changes. If you request, Croux will close your account and remove your personal data from the Platform according to applicable law. Some personal data will be maintained to comply with law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, and enforce the Terms of Service.
You may also request human review of automated decisions, request correction of AI-generated profile content, or request a human-conducted alternative to TARA intake by contacting support@croux.co.
Account Protection
Do not disclose your password to anyone. You are responsible for all actions under your username and password. If your password has been compromised, please change it immediately.
Security
Croux will make every reasonable effort to protect your personal data. Croux makes no warranty or promise that your personal data or private communications will not be intercepted due to unauthorized access or disclosure.
Children
The Platform is not directed to children under the age of 13. Croux adheres to the Children's Online Privacy Protection Act (COPPA) and will not knowingly collect Personal Information from any child under the age of 13. If a child under the age of 13 has provided Croux with Personal Information, a parent or guardian may contact Croux to request deletion from our records.
Notice to California Users
If you are a California user, the following provisions apply to our processing of your California Personal Information. These provisions prevail over any conflicting provisions in other sections of this Privacy Policy.
We have collected the following categories of California Personal Information within the last 12 months:
- Identifiers: name, alias, postal address, online identifier, IP address, email address, account name
- Personal information under California customer records statute: name, address, telephone number, financial information
- Commercial information: products or services purchased, purchasing histories or tendencies
- Internet or other network activity: browsing history, search history, interactions with websites or advertisements
- Geolocation data: physical location or movements
- Sensory data: audio recordings, including recordings of TARA interactions; electronic, visual, or similar information
- Inferences: profile about consumer preferences, characteristics, and behavior, including inferences generated by automated tools (such as TARA) about skills, certifications, availability, experience, and eligibility indicators such as the Trust Score
We do not sell, and within the last 12 months have not sold, California Personal Information.
Automated Decision-Making. Croux uses automated tools, including artificial intelligence, to support eligibility determinations, the Trust Score, fraud and safety assessments, and Talent profile creation. For any significant decision that is materially influenced by these tools, you may request a human review by contacting support@croux.co. You may also request information about the categories of personal information used and request correction of inaccurate AI-generated content about you.
California Privacy Rights
If you are a California user, you have the right to request disclosure of the specific pieces, categories, sources, business purpose, and third-party sharing of California Personal Information we have collected about you. You also have the right to request deletion of California Personal Information we have collected from you.
You may exercise these rights by calling us at (205) 973-6689 or emailing support@croux.co. We will verify your identity before granting access or acting on your request. We may not discriminate against you for exercising any of these rights.
Transfers of Personal Data
The Platform is hosted and operated in the United States through Croux and its service providers. If you do not reside in the U.S., laws in the U.S. may differ from the laws where you reside. By using the Platform, you acknowledge that your Personal Data is being provided to Croux in the U.S. and will be hosted on U.S. servers, and you authorize Croux to transfer, store and process your information to and in the U.S., and possibly other countries.
